Terms of Service

1. Acceptance of Terms

By accessing and using LandscapeAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and LandscapeAI.

2. Service Description

LandscapeAI provides AI-powered landscape design visualization tools. Our Service allows users to upload photographs of outdoor spaces and receive AI-generated design concepts, including but not limited to layout suggestions, planting ideas, style visualizations, and remodel concepts. The Service is available through our website and may include free and paid subscription tiers.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Upload photos that you do not have the right to use or that infringe on third-party rights.
  • Attempt to reverse-engineer, decompile, or disassemble our AI systems or algorithms.
  • Use automated tools (bots, scrapers) to access the Service without our written permission.
  • Circumvent usage limits, authentication mechanisms, or security features.
  • Use the Service to generate content for illegal purposes or to deceive others.
  • Resell, sublicense, or redistribute generated designs without authorization from the original account holder.
  • Interfere with or disrupt the Service or servers connected to it.

6. Intellectual Property & Data Handling

Your Content: You retain ownership of photos and other content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process it for the purpose of providing our Service.

No Data Storage: We do not store your uploaded photos, text prompts, or any user-submitted content on our servers after processing is complete. Once your design concept is generated and delivered, all uploaded content is automatically purged from our processing pipeline. We do not retain, archive, or use your submissions for any purpose beyond the immediate generation of your design.

Generated Designs: AI-generated design concepts are provided for your personal and professional planning use. You may use generated designs to communicate with landscapers, plan projects, and visualize ideas. You may not claim AI-generated designs as original human-created work for professional portfolio or competition purposes.

Our Intellectual Property: The Service, including its AI models, algorithms, user interface, branding, and documentation, is owned by LandscapeAI and protected by intellectual property laws. You may not copy, modify, or create derivative works of our Service.

7. Payment Terms & Subscriptions

  • Free tier provides limited generations with core functionality.
  • Paid plans (Pro, Premium) are billed on a recurring monthly or annual basis.
  • Payment is processed through our third-party payment provider. You agree to provide accurate billing information.
  • Prices may change with 30 days' prior notice. Existing subscribers will be notified before any price increase takes effect.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • No partial refunds are provided for unused portions of a billing period unless required by applicable law.

8. Refund Policy

If you are dissatisfied with our Service, you may request a refund within 14 days of your initial purchase or renewal. Refund requests should be sent to our support email. Refunds are processed to the original payment method within 5–10 business days. Repeated refund requests may result in account review.

9. Service Availability & Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes. Scheduled maintenance windows will be communicated in advance when possible.

10. Limitation of Liability

AI-generated concepts are for planning and visualization only. They are not architectural blueprints, engineering plans, or professional landscape designs. Important limitations:

  • Designs do not account for local building codes, zoning regulations, or underground utilities.
  • Plant suggestions may not be suitable for your specific climate zone, soil type, or conditions.
  • Cost estimates, if provided, are approximate and may vary significantly from actual project costs.
  • LandscapeAI is not liable for outcomes of projects based on generated concepts.
  • We recommend consulting qualified landscape professionals before implementing any design changes.

To the maximum extent permitted by law, LandscapeAI's total liability for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless LandscapeAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated designs will meet your specific requirements, be accurate, or be error-free.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (intellectual property, limitation of liability, indemnification) will continue to apply.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LandscapeAI regarding the Service and supersede all prior agreements and understandings.

17. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or prominent notice on our website. Continued use of the Service after changes constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service.
